Helen Kerr, 73 – Pneumonia, Carnival Legend Passenger, September 6, 2006, Time of Death is unknown.
Attorney John H. (Jack) Hickey has filed a lawsuit on behalf of the William Kerr, husband of Helen Kerr, 73, after she died September 2, 2006 on board the Carnival Cruise Lines’ Carnival Legend, allegedly due to medical malpractice.
According to court documents the suit alleges that the ship’s doctor and infirmary staff misdiagnosed and mistreated Kerr while she was on board the Legend.
On the night of September 6, 2006, Kerr was suffering from a large amount of fluid in her lungs. She went to the infirmary on the ship where the medical staff pumped her full of more fluid.
The suit alleges that Kerr died as a result of the added fluid, which was the wrong treatment for her symptoms. According to the complaint, the cruise line medical staff in effect allowed Kerr to drown in her own fluids.
As Kerr was suffering, the Captain of the ship would not allow or enable Kerr to be evacuated to a full medical center, with regard apparently only to the itinerary and budget of the ship.
The suit was filed September 6, 2007 in the District Court for the Southern District of Florida, Miami Division. Case No.: 07=22307 CIV.
